Recent Jury Trial Victory
On August 26, 2009, Scott Frankel obtained a complete acquittal for his client after a jury found him not guilty of aggravated assault, resisting a peace officer, criminal trespass to real property, and disorderly conduct.
Recent Federal Court Victory
On July 7, 2009, Scott Frankel obtained a dismissal of a federal narcotics case for a client charged with conspiracy to possess five kilograms of cocaine. The case involved a D.E.A. investigation in which a confidential informant allegedly attempted to sell cocaine to the defendants. Mr. Frankel’s client was captured on tape allegedly accepting a payment for “brokering” the transaction. The government dismissed the case just two weeks prior to the scheduled trial date.
Recent Victories in Capital Cases
On August 4, 2009, Scott Frankel won an
Atkins hearing for a client in a capital case when, after a contested four-hour hearing, the court declared Mr. Frankel’s client to be mentally retarded, thereby barring the death penalty.
On November 6, 2009, Keith Spielfogel and Scott Frankel obtained a 55 year sentence for their client, Pierre Cole, following a capital sentencing hearing during which the prosecution requested the Court impose the death penalty.
Recent Appellate Victory
On December 10, 2008, Attorney Scott J. Frankel won a complete victory for his client, Charles DeFilippo, a 22-year veteran of the Lake County Sheriff's Department and former director of the Lake County Jail. Mr. Frankel was retained to handle the appeal of Mr. DeFilippo's conviction for forgery. Based on Mr. Frankel's argument that the facts of the case could not support a conviction for forgery, the Appellate Court of Illinois, Second District, concluded that the conviction must be reversed based on insufficient evidence.

Recent Victory in the Illinois Supreme Court
